Electricity Industry Law Reform: Compatible with the Constitution and International Treaties?

Héctor Garza, Marco Portillo and Ana Martínez, explain in the following article published in ICC’s March 2021 business bulletin, the fact of how the recent reform to the Electric Industry Law reduces competition in the private sector and limits the development of renewable projects, eventhough both the Constitution and the International Treaties of which Mexico is a party, protect the rights to a clean environment and free competition. Therefore, there are defense mechanisms available for investors to protect rights affected by this reform.
