Competition Law International - Constitutional developments in Mexico: Effects on the antitrust landscape
Our associates, Marta Loubet and Julia Fuentes, published an article in the Competition Law Section of the International Bar Association, analyzing recent developments in Mexico’s competition regulatory framework. Their work examines the upcoming abolition of the current competition authorities, the Federal Economic Competition Commission (COFECE) and the Federal Telecommunications Institute (IFT, regulator of the telecommunications and broadcasting sectors), as a result of the constitutional reform known as the Organic Simplification Reform, published on December 20, 2024 (the “Reform”).
In the article, the authors provide a concise historical overview of Mexican competition law and review the Reform, along with the three initiatives proposed to update the Federal Economic Competition Law and establish a new competition authority. In particular, considering the third and final initiative, approved after the article’s publication, they share their insights on the potential implications of these changes for the enforcement of Mexico’s competition regime.
